Підстави виплати ГЗ та ДВ з 31 дня відрядження?
Доброго дня!
На підставі статей 1, 13, 19, 20 Закону України «Про доступ до публічної інформації» від 13 січня 2011 року, які надають право звертатись із запитами до розпорядників інформації щодо надання публічної інформації, прошу надати наступну інформацію:
Відповідно до пункту 4 Інструкції про відрядження військовослужбовців Збройних Сил України, затвердженої наказом Міністерства оборони України від 20.02.2017 № 105 (далі — Інструкція № 105), строк відрядження визначається командиром (начальником, керівником), але не може перевищувати в межах України 30 календарних днів з урахуванням часу перебування в дорозі, крім випадків, коли інші строки відрядження визначаються законодавчими та іншими нормативно-правовими актами.
Аналогічне обмеження встановлено пунктом 6 постанови Кабінету Міністрів України від 02.02.2011 № 98 «Про суми та склад витрат на відрядження державних службовців, а також інших осіб, що направляються у відрядження підприємствами, установами та організаціями, які повністю або частково утримуються (фінансуються) за рахунок бюджетних коштів» (далі — Постанова № 98), згідно з яким строк одного відрядження не може перевищувати в межах України 30 календарних днів, за кордон — 60 календарних днів, крім випадків, зазначених в абзацах другому — вісімнадцятому цього пункту.
У зв'язку з наведеним та з метою правильного застосування зазначених норм прошу надати письмове роз'яснення (з посиланням на конкретні норми законодавства, що регулюють порядок і підстави нарахування грошового забезпечення та додаткової винагороди військовослужбовцям) з наступних питань:
1. Чи є підстави для здійснення виплати грошового забезпечення та додаткової винагороди військовослужбовцям, які вибули у відрядження до інших військових частин, очікують на переведення та фактично не виконують завдань, що дають право на нарахування грошового забезпечення з розрахунку 30 000 / 5 000 / 100 000 гривень починаючи з 31-го дня такого відрядження?
2. Чи є підстави для здійснення виплати грошового забезпечення та додаткової винагороди військовослужбовцям, які вибули до територіальних центрів комплектування та соціальної підтримки (ТЦК та СП) до окремого розпорядження з 31-го дня такого відрядження?
